Terms and conditions


This website belongs to SMART PREMIUM RENT A CAR SERVICES SRL, a romanian legal entity having its registered office at Bucharest, 4th District, Turnu Magurele Street, no. 52 - 62, with the number in the Trade Register J40/20558/2022, unique registration code RO47016488 Any reference in this website at SMART PREMIUM RENT A CAR SERVICES SRL will be achieved through using the name Bsmart- Rent A Car.

1. Any person who wishes to conclude a rental car agreement must present the original identity card or passport for those who have a foreign nationality and the driving license, both beeing available during the renting period of the car. The driving license B category must be at least 12 months old since it was issued. Our company does not conclude any rental car agreement with clients that not have a driving license but have a substitute proof. The driving license and also the identity card must be available at least other 3 months after concluding the rental car agreement.

2. Any person who rents a car must be at least 21 years old and up to 65 years old, and have a driving license at least for 1 year at the time when he concludes the rental car agreement with Bsmart- Rent A Car.

3. The person who rents the car must declare at the moment of signing the rental contract if there are any other persons who will drive also the car during the rental period, their names and surnames, period in which the client still responds for the rented car.

4. The use of the rented car by other persons beside the ones mentioned in the rental car contract is strictly prohibited.

5. The payment will be made at the moment when the contract is signed and/or when the car is delivered to the client. Also, the client has the posibility to make the payment directly in the bank account of Bsmart- Rent A Car, through bank transfer, in advance, so that the company receives the money before the take over of the car by the client. In the case of online payments using the credit cards, the authentication of the cards regarding their validity and their security will be confirmed by the processor of the electronic payments. The transactions will be strictly made through the informatic systems of the online processor, in maximum safety conditions offered by the platform beeing assured antifraud filters on every online transaction. No information regarding the card of the client will not be stored on the Bsmart- Rent A Car servers. There are accepted for the payment the debit credit card, those of debit with overdraft or the credit cards, issued under the name of MasterCard, Maestro, Visa, Visa Electron. The processor of electronic payments is MOBILPAY.

6. The payment will be made in LEI at the exchange rate calculated on the website, in the section Useful Links/ Exchange Rate. At the moment when the car is received by the client, the client will sign a minute regarding the giving and the receiving of the car which will contain the exactly description of the car condition. When the client takes back the car, he have to bring the car in the same conditions as he received it.

7. At the moment when the contract is signed, the client has the obligation to pay a guarantee, according to the type of the rented car. The guarantee is between 250 and 700 euros, according with the car classify. This guarantee can be payed with cash or can be retained from the credit card at the moment of the car delivery.

8.  Additonal insurance protection:
Extended Road Assistance (20 euro)
Protection – by renting the Extended Road Assistance, will exempt you from paying the expenses for technical assistance granted to the vehicle 24/24, in case of immobilisation of the vehicle:
      - the lost of the vehicle key;
      - closing the vehicle with the key inside;
      - discharging the battery as a result of negligence in use;
      - mischarging the fuel supply;
      - tire destruction.
If this additional service has not been purchased, following an immobilisation case presented above, the customer will pay the full value for road assistance.
Exclusions - Extended Road Assistance does not reduce your financial liability to the consequences of vehicle immobilisation, repair costs, parts replacement, vehicle damage and / or theft, for which you are in any case responsible. Extended Road Traffic Insurance is valid exclusively on Romanian territory. It does not apply if the vehicle is immobilized outside public roads.

Zero liability in case of damage the back window of the vehicle (15 euro)
Protection - by accepting The Back Window Insurance service, you will be relieved of financial liability in the event of damage to the vehicle's back window (scratches, flaws, breakage).
Exclusions - The Insurance of the back window service does not reduce your financial liability for other damages to the vehicle (especially the panoramic roof and rearview mirrors) or vehicle theft, for which you will respond in any case.

Zero liability in case of damage the windscreen of the vehicle (20 euro)
Protection - by accepting The Windscreen Insurance service, you will be relieved of financial liability in the event of damage to the vehicle's windscreen (scratches, flaws, breakage).
Exclusions - The Insurance of the windscreen service does not reduce your financial liability for other damages to the vehicle (especially the panoramic roof and rearview mirrors) or vehicle theft, for which you will respond in any case.   

Zero liability in case of damage the tires of the vehicle (20 euro)
Protection - by accepting the Tire Insurance service, you will be relieved of financial liability in case of damage to the vehicle tires (flat tire, tire cuts).
Exclusions - The Tire Insurance service does not reduce your financial liability for any other damage to the vehicle (tray wheels or alloy wheels scratched or hit) or vehicle theft, for which you will respond in any case.  

Zero liability in case of damage the tapestry of the vehicle (35 euro)
Protection - by accepting The Upholstery Insurance service, you will be relieved of financial liability in the event of damage to the vehicle's upholstery (stains, excessive dirt, animal hair, tearing, cigarette burning).
Exclusions - The Upholstery Insurance service does not reduce your financial liability for any other damage to your vehicle (safety belts, stained car seat, seat adjustment) or vehicle theft, for which you are in any case responsible.

Zero liability in the case of damage to the bodywork of the vehicle (35 euro)
Protection - by accepting The Vehicle Bodywork Insurance, you will be relieved of financial liability in the event of damage to the vehicle bodywork (fine scratches on the surface of any element which does not requires paint).
Exclusions -  The Vehicle Bodywork service does not reduce your financial liability for any other damage to the vehicle (any other situation requiring repainting and repair) or vehicle theft, for which you do in any case.

9. The minimum rental period is 1 day, with a mileage limit of 50km/day. For rentals of 2 consecutive days, the mileage limit is 125 km for the entire rental period. For rentals of 3 consecutive days, the kilometer limit is 350 km for the entire rental period, for rental periods between 4 - 14 days the km limit is 2,500 km/rental and for rental periods between 15 - 30 days the limit is of 3,000 km / rental. These limits can be exceeded, but there will be an additional fee of 0.1 euro + VAT for each km exceeded.

10. The rented car can not be used for the towing of others cars, for paid transport of goods and/or persons, for racing, rallys or other any of these activities.

11. The sublease of the rented car is strictly prohibited.

12. The extension of the rental car agreement will be made only with the written accept (including fax, e-mail) of Bsmart- Rent A Car.. The extension of the rental car period will be made only after the advanced payment of the renting car services for the extended period. The extension of the renting period is strictly prohibited in any other conditions then those mentioned. Otherwise, the owner of the car has the right to announce any incident to the competent authorities.

13. The client has the obligation to announce with 12 hours before, in written ( including fax, e-mail) any delay concerning the delivery of the rented car. It is allowed to delay maximum one hour the delivery of the car by the client. Any other delay between - and 3 hours, which is not announced biy the client, it will be penalized with 50% of the tax established per one day for the car, and for a delay more then 3 hours the client must pay the price for one day of rentig for that car.

14. The delivery and the giving back of the car it will be made at the day and the hour established by the client and accepted by the owner, between 08:00 - 19:00 (from Monday to Friday) and between 08:00 - 14:00 (on Saturday), at our headquarters. The delivery and/or the giving back of the rented car different then those mentioned above, will be made with the agreement of the owner, with a suplimentary tax, as those mentioned:

  • for the delivery and/or giving back of the car at our headquarters between 19:00 - 08:00 (from Monday to Friday) it is required an additional tax of 15 euros, or between 14:00 - 08:00 (from Saturday to Sunday) an additional tax of 15 euros, and a tax of 15 euros for Sunday (all day);
  • for the delivery and/or giving back of the car at Otopeni Airport (Henri Coanda), between 08:00 - 19:00 (from Monday to Friday), it is required an additional tax of 15 euros, between 19:00 - 08:00 (from Monday to Friday), it is required a tax of 25 euros. Between 08:00 - 14:00 (on Saturday), it is required a tax of 15 euros, between 14:00 - 08:00 (from Saturday to Sunday), it is required a tax of 25 euros, and a tax of 25 euros for Sunday (all day).

15. The violation of traffic rules, the fees and the parking taxes are the strictly responsibility of the client and they will be payed integraly by the client.

16. If case of accident it is mandatory to declare it to the Police departament which will evaluate the damages of the car and will give a report minute and the repairs authorization. This documents are mandatory for the validity of the insurance and for the repair of the damaged car. The police statement is mandatory in any case: if the client is guilty, if he is the victim, if you damahe alone the car, if the guilty part is not identified ( ex. Damages in the parking area when the client does nor know). Without these documents the client is personal responsible for the repairs of the car.

17. If any of this conditions are not met by the client, the rental company can ask for an additional guarantee that will be established taking in consideration the value of the damage, guarantee that will be given back only if at the end of the period of the renting contract, the client gives back the car in a good shape and operation, with all the needed documents, accessories and equipments.

18. Bsmart- Rent A Car  does not take the resonsability for the fluctuation of cars from the fleet. The reservation of the renting car it is considered made after the confirmation given by a delegate Bsmart- Rent A Car  through e-mail or phone.

19. If the person who wants to conclude a rent car agreement has the age between 21 and 25 years old, an additional tax of 4 euros/day VAT included will be payed by the client ( tax for the young drivers). The maximum tax for the young driver is 40 euros for every rented car.

20. The “Premium” class cars can not be rented by persons under 25 years old.

21. For the reservations for which the payment was not done in advance, the client can cancel or change the reservation with 48 hours before the delivery of the car. For changing the reservation there won't be any penalties. Also for the cancelation of a reservation there won't be penalties. For the reservations for which the payment was made in advance, the client can cancel or change the reservation with 48 hours before the delivery of the car. For changing the reservation there won't be any penalties. If the payment was made, canceling the reservation will not give the right to receive back the paid money for the reservation.

22. Any dispute concerning the chapter “ Terms and Conditions” will be solved out by the competent court from the headquarter of Bsmart- Rent A Car .
